內(nèi)容概要

  《上海交通大學(xué)文治掌學(xué)術(shù)著作叢書·馬丁文集(8):法律語(yǔ)言研究》收錄了馬丁2008年以來(lái)發(fā)表的11篇有關(guān)法律與語(yǔ)言的學(xué)術(shù)論文。第一篇是指導(dǎo)語(yǔ)篇語(yǔ)義研究的理論框架,其他各篇是在這個(gè)理論框架下對(duì)恢復(fù)性司法語(yǔ)篇的研究。研究的焦點(diǎn)涉及澳大利亞新南威爾士州青少年犯罪司法調(diào)解協(xié)商會(huì)中的耦合現(xiàn)象、身份建構(gòu)、語(yǔ)類結(jié)構(gòu)特點(diǎn)等。本卷論文是體現(xiàn)化、實(shí)例化和個(gè)性化三個(gè)層級(jí)理論應(yīng)用的集萃。

作者:(澳)馬丁(J. R. Martin)王振華,博士,上海交通大學(xué)外國(guó)語(yǔ)學(xué)院教授、博士生導(dǎo)師、學(xué)科負(fù)責(zé)人、英語(yǔ)系副主任、外國(guó)語(yǔ)言文學(xué)博士后流動(dòng)站站長(zhǎng)。曾任河南大學(xué)外語(yǔ)學(xué)院科研副院長(zhǎng),河南省教育廳學(xué)術(shù)技術(shù)帶頭人。1999年獲澳大利亞悉尼大學(xué)語(yǔ)言學(xué)碩士學(xué)位,2003年獲河南大學(xué)語(yǔ)言學(xué)博士學(xué)位,2004年入復(fù)旦大學(xué)外國(guó)語(yǔ)言文學(xué)博士后流動(dòng)站,研究課題為《語(yǔ)言評(píng)價(jià)系統(tǒng)與司法語(yǔ)言規(guī)范研究》。兼任中國(guó)功能語(yǔ)言學(xué)研究會(huì)副會(huì)長(zhǎng),中國(guó)英漢語(yǔ)篇研究會(huì)副會(huì)長(zhǎng),中國(guó)法律語(yǔ)言學(xué)研究會(huì)名譽(yù)副會(huì)長(zhǎng),金博大律師事務(wù)所上海分所專家顧問(wèn),《當(dāng)代外語(yǔ)研究》和《功能語(yǔ)言學(xué)與語(yǔ)篇分析研究》編委。出版著作(含教材)8部,發(fā)表論文50余篇,主編《馬丁文集》8卷,特約主編《當(dāng)代外語(yǔ)研究》2010年第10期,承擔(dān)各級(jí)各類科研項(xiàng)目14項(xiàng),在研項(xiàng)目有《法律語(yǔ)篇的行為規(guī)范研究》(上海市社科規(guī)劃項(xiàng)目,2007)、《語(yǔ)篇語(yǔ)義研究的理論體系建構(gòu)與實(shí)踐》(國(guó)家社科項(xiàng)目,2008)、《人際和諧的態(tài)度考量》(“211工程”第三期資助項(xiàng)目,2010)。研究興趣主要有系統(tǒng)功能語(yǔ)言學(xué)、語(yǔ)言評(píng)價(jià)理論、語(yǔ)篇語(yǔ)義研究、法律語(yǔ)言研究、語(yǔ)用學(xué)、教育語(yǔ)言研究。馬丁(J.R.Martin),博士,國(guó)際著名系統(tǒng)功能語(yǔ)言學(xué)學(xué)家,悉尼大學(xué)教授、語(yǔ)言學(xué)系系主任,“語(yǔ)言評(píng)價(jià)理論”和“積極話語(yǔ)分析”創(chuàng)始人。研究興趣主要有系統(tǒng)理論、功能理論、語(yǔ)篇語(yǔ)義學(xué)、語(yǔ)域理論、語(yǔ)類理論、多模式系統(tǒng)、積極/批評(píng)話語(yǔ)分析、教育語(yǔ)言學(xué)和社會(huì)符號(hào)學(xué)。1998年當(dāng)選為澳大利亞人文學(xué)會(huì)研究員,2003年因其對(duì)語(yǔ)言學(xué)和語(yǔ)文學(xué)的貢獻(xiàn)榮獲澳大利亞“百年紀(jì)念獎(jiǎng)?wù)隆?。曾任Text雜志“評(píng)價(jià)系統(tǒng)”??骶?2003),Dcourse&.Societ)一??峡骶?2004)。發(fā)表論文140多篇,出版著作數(shù)十部。代表性著作有English Text(1992);Working with Discourse(2003.revised 2007);Re/Reading the Past(2003);Languageepology(2004);The Language of Evaluation(2005);Genre Relations(2C308),Language,Knowledge andPedagoogy(2007);Deploying Functional Grammar。(2010);New Discomse on Language(2010)。

  While lines connecting the circles are intendedto suggest the interrelatedness of the meanings, they might be omitted for visualclarity. The limitation of a static 2D drawing of this kind is that logogenesiscannot be represented and hence we cannot capture information about the phaseof a text likely to contain particular couplings. Links that are in bold areintended to represent a co-instantiation that is more likely to occur. Whilebeyond the scope of this paper, text visualisation techniques employing 3Dnetworks are likely to be useful avenues for exploring how to representsyndromes.  As Figure 2 suggests, tempering occurs in each of the metafunctions. Theoverall meaning is generated by the particular couplings that are instantiatedacross strata and across the systems within these metafunctions. Tempering inthe textual metafunction by the young persons often involved embedding apossible target of evaluation in a structure with reduced availability forcontestation. For example it might be embedded with a nominal group or anembedded clause. As Halliday and Martin pomt out "you can argue with aclause but you can't argue with a nominal group" (Halliday and Martin 1993:39). In this way textual tempering allows the young person to dodge probingquestions by generating fewer targets for direct evaluation.  Interpersonal tempering, as instantiated in this Youth Justice Conference,typically deployed resources of GRADUATION and ENGAGEMENT.Graduation was used to tone down force and focus, reducing intensity andquantity, and blurring the boundaries of entities and processes. For example, while, in order to access a conference, a young person has admitted to the facts of their case, they may wish to grade the scope of their intentions and actions as minimal, within the constraints that those facts impose. In addition, opposingvoices were distanced using engagement. For example, the young personsattempted to close down voices that had the potential to scale up 'thegraduation.  ……
