內(nèi)容概要

本書選取中國最高人民法院及地方法院共26個近年來較為典型的知識產(chǎn)權(quán)案例進(jìn)行編譯，提煉案情，總結(jié)裁判要旨，并進(jìn)行相關(guān)法理評析。全書分為兩編，第一編15個案例由判決原文的中、英文編譯稿組成；第二編11個案例主要對判決進(jìn)行英文編譯，而判決原文作為附錄，以便展示法院判決的要點和相關(guān)法律的適用全貌。
 讀者對象：知識產(chǎn)權(quán)領(lǐng)域的科研人員和實務(wù)工作者，以及普通大眾。

版權(quán)頁：The Court of first instance deems that the allegedly infringing product has three regressiontechnical features and one equivalent technical feature as compared to the patent in suit,making it inferior to the patent technology of Zhilian Company. So the technology whichGaolian Company holds, as a regression technology, infringes the Zhilian Company'sexclusive patent right of exploitation. According to the patent description, the water circuit breaker has a complicatedbreathing apparatus that can inhale and exhale regularly when the system is unstable, inorder to maintain the normal pressure in the system. The system adopts water sealtechnology. The buffer device of Gaolian Company, however, has a check exhaust valvethat is only able to perform exhalation but riot inhalation. As a result, the system cannotrun when it is unstable, especially when the pre:ssure in the buffer device is below the atmospheric pressure. The check exhaust valve of Gaolian Company, compared with the breathing apparatus of the patented water circuit breaker Zhilian Company holds, is aregression technology that can be achieved by any technician skilled in HVAC areas byreading the description without any creative work.   There is a threaded guide plate in the water circuit breaker of Zhilian Company, which ismade for water-gas separation by turning the water in the water circuit breaker intomembrane flow. Though the buffer device of Gaolian Company applies the membrane flowprinciple too, it does not have the threaded guide plate that reinforces the decompressionand deceleration effect. So the buffer device of Gaolian Company is not as good as the patented technology of water circuit breaker of Zhilian Company, thus becomes an otherregression technical feature.
