作者簡介
盛建明,法學(xué)博士,對外經(jīng)濟(jì)貿(mào)易大學(xué)法學(xué)院教授、博士生導(dǎo)師,WT0法律研究中心主任,中國國際經(jīng)濟(jì)法學(xué)研究會常務(wù)理事,曾任北京市人民政府法律專家顧問、北京環(huán)中律師事務(wù)所反傾銷部副部長等。主要講授課程有:國際經(jīng)濟(jì)法、反傾銷法、貿(mào)易管制法等。2005年榮獲對外經(jīng)濟(jì)貿(mào)易大學(xué)首屆青年教師基本功大獎(jiǎng)賽冠軍和最佳教案獎(jiǎng)。主要學(xué)術(shù)專著有:1994年出版的《反傾銷國際慣例》是我國關(guān)于介紹和研究反傾銷法的最早的專著之一;2000完成美國證券評級機(jī)構(gòu)的法律責(zé)任的系統(tǒng)深入的研究,并通過博士論文答辯,于2005年出版《美國證券評級機(jī)構(gòu)的法律責(zé)任》,該書比西方學(xué)者對證券評級機(jī)構(gòu)責(zé)任問題的研究成果要早發(fā)表3至4年,被我國法學(xué)界前輩沈達(dá)明教授譽(yù)為填補(bǔ)該領(lǐng)域世界學(xué)術(shù)空白之作。此外,作者近年來在《中國法學(xué)》、《國際貿(mào)易問題》、《國際貿(mào)易》等刊物發(fā)表了關(guān)于國際經(jīng)濟(jì)法,特別是WTO法的一系列文章。作者曾于2003年受商務(wù)部委托,完成了多哈回合貿(mào)易規(guī)則美國談判立場的科研項(xiàng)目,并在此基礎(chǔ)上為我國政府提交了兩份代表我國政府在貿(mào)易規(guī)則談判方面立場的兩份英文提案草案,一份題為《關(guān)于反傾銷調(diào)查中因果關(guān)系確定原則的澄清》,另一份題為《關(guān)于延長綠燈補(bǔ)貼之提案》。此外,在中國政府參加的第一起利用WTO爭端解決機(jī)制保護(hù)我國貿(mào)易利益的案件,即美國201鋼鐵保障措施案件中,作者作為環(huán)中律師事務(wù)所律師負(fù)責(zé)起草的關(guān)于“中國應(yīng)享有發(fā)展中國家待遇”的2萬余字英文材料,體現(xiàn)了其深厚的貿(mào)易法功底,此案最后以包括中國在內(nèi)的全體申訴方的勝訴而告終。

版權(quán)頁:插圖:Second, in order to ensure safety of overseas investment made by their own nationals,many developed countries tend to respectively conclude bilateral treaties or agreements with developing countries that absorb foreign investment on the mutual protection of investments made by nationals of the other party. At the same time investment insurers established by governments of developed countries (such as the Overseas Private Investment Corporation, or OPIC, set up by US Government) usually conclude insurance contracts with their own investors that invest overseas to insure political risks related to such overseas investment.Upon occurrence of risk incidents covered by such insurance, these insurers will pay claims as stipulated in the contract and then replace the insured's legal status as the creditor and exercise their subrogation rights to claim, from the host country government. To prevent the host country government from refusing to pay claims afterward, the developed countries incorporate special provisions into their bilateral treaties or agreements with the host countries about mutual protection' of investment by their respective nationals to constrain the host country governments, i.e., stipulating that the host country gvernments agree that the foreign investment insurers enjoy the rights of subrogation.
