為了留出足夠的時間供賣方繕制裝運單證和向銀行辦理議付,信用證中的裝運日期與到期日應(yīng)至少相隔兩星期。有時賣方未能及時將貨物備妥待運,或買方由于這樣或那樣的理由要求延遲裝運,這時賣方將不得不要求延展信用證中的裝運日期和到期日期。 賣方(出口商)在收到有關(guān)信用證后,首先應(yīng)作一次詳細(xì)的審核,看信用證中規(guī)定的條款是否完全與銷售合同(或銷售確認(rèn)書)所訂明的條款相符。這一步驟很重要。兩者之間的細(xì)小差異,如未發(fā)現(xiàn)或未改妥,將會給賣方造成許多麻煩,因為議付銀行會按照開證銀行的指示,拒絕議付該單證。因此,如在信用證中發(fā)現(xiàn)差異或一些先前未見到的特殊條款,而賣方又不能同意,則應(yīng)通知買方予以修改。有時,可能會有關(guān)于貨源、裝運等意料之外的情況發(fā)生,這時,也必須修改原來的信用證?! 〔粌H賣方可以要求修改信用證,買方若發(fā)現(xiàn)信用證中需要修改的地方,也可以要求修改。通常的手續(xù)是,買方首先應(yīng)征得賣方的同意,然后通知開證銀行修改信用證。審核信用證的基本要點如下:1.信用證本身的審核:(1)信用證的性質(zhì):是否為不可撤銷。(2)適用慣例:是否申明所適用的國際慣例規(guī)則。(3)信用證的有效性:檢查是否存在限制生效及其他保留條款,注意電開信用證是否為簡電信用證?! 。?)信用證當(dāng)事人:對開證申請人和受益人的名稱和地址要仔細(xì)加以核對?! 。?)信用證到期日和到期地點:到期日應(yīng)符合買賣合同的規(guī)定,一般為裝運后15天或20天,到期地點一定要規(guī)定在出口商所在地以便做到及時交單?! ?.專項審核: ?。?)信用證金額、幣種、價格術(shù)語、付款方式是否與合同一致?! 。?)商品品名、貨號、規(guī)格、數(shù)量是否與合同一致?! 。?)信用證中的裝運條款包括裝運期限、裝運港、卸貨港、分批裝運或轉(zhuǎn)運等規(guī)定是否與合同一致?! 。?)對信用證項下要求受益人提交議付的單據(jù)通常包括:商業(yè)發(fā)票、保險單、海運提單、裝箱單、原產(chǎn)地證明、檢驗證書以及其他證明文件,要注意單據(jù)由誰出具、能否出具,信用證對單據(jù)是否有特殊要求,單據(jù)的規(guī)定是否與合同條款一致,前后是否有矛盾。
