內(nèi)容概要
通過對媒介法律顧問、記者、編輯、媒體管理者的訪談以及近20來年的媒體名譽(yù)權(quán)案件的分析,《媒體與名譽(yù)侵權(quán)》發(fā)現(xiàn):大部分媒體名譽(yù)權(quán)官司原告為普通公民,在案件討論中側(cè)重于損害的名譽(yù)的救濟(jì)而不是言論自由的爭論。同時,商業(yè)化的媒體更多地注重自身經(jīng)濟(jì)利益訴求和成本核算而不是看重普遍的言論自由權(quán)利的拓展。從自身經(jīng)濟(jì)利益和成本考慮,名譽(yù)權(quán)官司使得媒體更嚴(yán)謹(jǐn)對待報道和報道者的權(quán)益,反倒有利于促進(jìn)媒體報道的真實和媒體倫理的發(fā)展,從一定程度上說,有利于言論而不是鉗制言論。并且,從整個名譽(yù)權(quán)法律的設(shè)計和具體司法實踐中名譽(yù)權(quán)案件的處理來看,中國名譽(yù)權(quán)法律的設(shè)計本身沒有對言論的鉗制和懲罰設(shè)置,而具體司法實踐對名譽(yù)權(quán)官司的處理中,主要目的也是用來保護(hù)名譽(yù)權(quán)和為名譽(yù)損害提供救濟(jì),無論是原告還是法院都較少利用名譽(yù)權(quán)官司本身來懲罰言論。
作者簡介
陳曉彥,媒體法博士,主要研究方向為媒體法律、媒體政策和媒體倫理?! ?008年于南洋理工大學(xué)(新加坡)獲得媒體法博士學(xué)位,2001年在國內(nèi)通過律師資格考試并獲司法部頒發(fā)的律師資格證書。迄今已在媒體侵權(quán)、互聯(lián)網(wǎng)管理等領(lǐng)域發(fā)表中、英文論文若干,并多次赴美國、德國、英國以及香港地區(qū)等參加國際學(xué)術(shù)會議、研討會和進(jìn)行學(xué)術(shù)交流。
