媒體與名譽侵權(quán)

內(nèi)容概要

　　通過對媒介法律顧問、記者、編輯、媒體管理者的訪談以及近20來年的媒體名譽權(quán)案件的分析，《媒體與名譽侵權(quán)》發(fā)現(xiàn)：大部分媒體名譽權(quán)官司原告為普通公民，在案件討論中側(cè)重于損害的名譽的救濟而不是言論自由的爭論。同時，商業(yè)化的媒體更多地注重自身經(jīng)濟利益訴求和成本核算而不是看重普遍的言論自由權(quán)利的拓展。從自身經(jīng)濟利益和成本考慮，名譽權(quán)官司使得媒體更嚴謹對待報道和報道者的權(quán)益，反倒有利于促進媒體報道的真實和媒體倫理的發(fā)展，從一定程度上說，有利于言論而不是鉗制言論。并且，從整個名譽權(quán)法律的設計和具體司法實踐中名譽權(quán)案件的處理來看，中國名譽權(quán)法律的設計本身沒有對言論的鉗制和懲罰設置，而具體司法實踐對名譽權(quán)官司的處理中，主要目的也是用來保護名譽權(quán)和為名譽損害提供救濟，無論是原告還是法院都較少利用名譽權(quán)官司本身來懲罰言論。

作者簡介

　　陳曉彥，媒體法博士，主要研究方向為媒體法律、媒體政策和媒體倫理?！　?008年于南洋理工大學（新加坡）獲得媒體法博士學位，2001年在國內(nèi)通過律師資格考試并獲司法部頒發(fā)的律師資格證書。迄今已在媒體侵權(quán)、互聯(lián)網(wǎng)管理等領域發(fā)表中、英文論文若干，并多次赴美國、德國、英國以及香港地區(qū)等參加國際學術(shù)會議、研討會和進行學術(shù)交流。
