前言

根據(jù)國家教育部頒布的《大學(xué)英語課程教學(xué)要求》,大學(xué)英語應(yīng)用提高階段的英語教學(xué)應(yīng)該使學(xué)生在聽讀方面能理解與本專業(yè)相關(guān)的口語和書面英語語篇,在說寫方面能用英語就專業(yè)問題自如地表達(dá)自己的看法和觀點(diǎn),在專業(yè)翻譯方面能在中英兩種語言之間自由地切換。熟練運(yùn)用專業(yè)英語進(jìn)行學(xué)術(shù)和實(shí)務(wù)方面的交流。無論是在法學(xué)學(xué)術(shù)還是在法律實(shí)務(wù)領(lǐng)域。國際化的形勢要求法律人既有扎實(shí)的專業(yè)知識,又能夠用外語打開對外交流的窗口,法律英語成為學(xué)校在校學(xué)生和研究者以及從業(yè)律師和其他法律工作者必須學(xué)習(xí)和掌握的功課。為配合該教學(xué)要求以及目前國際化的形勢,特編寫《法律英語教程》?!斗捎⒄Z教程》是針對法學(xué)專業(yè)高年級學(xué)生、法律實(shí)務(wù)工作者和法律英語愛好者編寫的專業(yè)英語教材,可供高校課堂或希望掌握法律英語的自學(xué)者使用。本教材選材均來源于最近的英文法學(xué)出版物,單元主題以美國法律制度為基點(diǎn),涵蓋了法學(xué)的各個(gè)領(lǐng)域,并按照法學(xué)專業(yè)知識的邏輯順序出現(xiàn),基本專業(yè)詞匯也因此得到了較為全面的呈現(xiàn)。本教材旨在幫助讀者在擴(kuò)展專業(yè)知識的同時(shí),掌握一定的專業(yè)英語詞匯,熟悉法律英語表達(dá)法,并進(jìn)一步鞏固英語語言基礎(chǔ),提高學(xué)生在專業(yè)領(lǐng)域內(nèi)綜合運(yùn)用英語語言的能力。本書共計(jì)十六個(gè)單元,每個(gè)單元包括一篇主課文和一篇副課文。主課文為該單元的精讀部分,除有生詞、語言點(diǎn)和背景知識的注釋外,還附有課文理解、詞匯以及聽說寫譯方面的綜合性配套練習(xí),以為有效的法律英語教學(xué)提供豐富的語言實(shí)踐活動。副課文是主課文在專業(yè)知識和專業(yè)詞匯方面的延伸。作為課堂學(xué)習(xí)的補(bǔ)充。此外,本書還附有主課文譯文、練習(xí)答案、聽力原文、總詞’匯表和參考書目,以方便自學(xué)者自學(xué)和查閱。對于本書的編寫,我們付出了大量的心血,力求對課堂教學(xué)和自學(xué)者能有所幫助。但由于各方面條件所限,恐多有不足之處,懇請各方專家和熱心讀者對教材提出批評和建議,以利教材的日后完善。

插圖:Appeal to natural, or higher, law provides a justification for civil disobedience.For example, if one's conscience tells one that war is morally wrong, then one hasa moral obligation not only to resist induction into the military, but also to commitovert acts of civil disobedience in order to raise the consciousness of the communityabout the evils of war. It was by appealing to the conscience of society thatMahatma Gandhi and Martin Luther King, Jr., were able to make both those inauthority and the general public see the immorality of colonialism and segregation.Proponents of animal rights have attempted to make the question of treatment ofanimals, especially during laboratory tests for drugs and cosmetics, into a moralissue that justifies admittedly illegal behavior such as sit-ins and breaking intofacilities to release animals. Invoking this higher law is one way in which a minoritycan hope to convince the majority to change its mind by appealing to the majority'ssense of morality.A discussion of natural law inevitably leads to the question of whether it ispossible to "legislate morality". If by legislating morality it is meant that law canchange a person's values, then law obviously cannot legislate morality. A lawprohibiting gambling is unlikely to prevent someone who sees nothing wrong with itfrom betting on the Super Bowl6. In such a case the law has altered neither theperson's values nor his or her behavior. Among those persons who choose not togamble are those who refrain from doing so out of fear of punishment rather than aconviction that gambling is "immoral".
