海上保險合同的訂立,雖然與其他合同的簽訂一樣,要遵循“要約”與“承諾”,但是,海上保險合同訂立所涉及的具體過程與其他類型合同的訂立過程不同,具有獨特性。在英國倫敦保險市場(國際上最大的海上保險市場),海上保險合同的訂立通常采用如下步驟:被保險人通過勞埃德認可的保險經(jīng)紀人來訂立合同;收至被保險人的指示后,保險經(jīng)紀人著手準(zhǔn)備承保條;填寫好承保條后,保險經(jīng)紀人帶著該承保條到市場上尋求保險:隨后,愿意承保的保險人在承保條底端簽上保險公司的名字以及其所承保金額的比例或百分比;當(dāng)保險經(jīng)紀人尋求到其所預(yù)期的承保金額時,承保條的簽署被截止;正式的保險單通常會在稍后被簽發(fā)?!队I媳kU合同的訂立》的主體分為三個部分。第一部分是關(guān)于在海上保險合同訂立完成之前相關(guān)的法律問題的討論。第二部分主要是涉及在合同訂立過程中發(fā)揮重要作用保險經(jīng)紀人的相關(guān)權(quán)利、義務(wù)以及責(zé)任。第三部分著重討論在海上保險合同訂立完成后所產(chǎn)生的相關(guān)法律問題。雖然該部分討論的問題出現(xiàn)在后合同階段,但是它們通常可以追溯到合同訂立的過程。一般來說,海上保險合同的訂立.應(yīng)當(dāng)受到合同法中一般原則的約束。《英國海上保險合同的訂立》的目的是分析合同法原則在解決海上保險合同訂立階段所涉及的相關(guān)法律問題中的應(yīng)用,并探討這些基本原則是否適用于解決與處理在英國倫敦保險市場實踐中出現(xiàn)的困難與問題。
作者簡介
張金蕾,1979年生,遼寧省本溪市人。2002年畢業(yè)于大連海事大學(xué)海商法專業(yè),獲法學(xué)學(xué)士學(xué)位;2004年畢業(yè)于英國斯旺西大學(xué)國際海商法專業(yè),獲法學(xué)碩士學(xué)位;2008年畢業(yè)于英國斯旺西大學(xué)國際海商法專業(yè)(海上保險方向),獲法學(xué)博士學(xué)位?,F(xiàn)為大連海事大學(xué)法學(xué)院講師,主要從事海商法、海上保險法、海事國際私法、法律專業(yè)英語的教學(xué)和研究工作。

版權(quán)頁:Here the defendant, Fennia, was the marine insurer of a cargo of paperand board, and had reinsured its liability under two facultative policies;a whole account cover, providing all risks protection; and a specificaccount cover, providing protection only against fire and floor damageto the goods while warehoused. The precise relationship between theseinsurances had never been resolved, and on February 14, 1997 Fenniainstructed its brokers to effect an amendment to the specific coverreinsurance by virtue of which the excess under that policy was to beincreased to 25 million Finmarks. The result as between the policieswas as follows: without the amendment, a loss of 27 million Finmarkswould have been distributed, 15 million Finmarks to the specific lossreinsurers and 10 million Finmarks to the whole account reinsurers.With the amendment, a loss of 27 million Finmarks would have beendistributed, 2 million Finmarks to the specific loss reinsurers and 20million Finmarks to the whole account reinsurers.
