內(nèi)容概要

　　《WTO法律制度：以案說法（1）》作為世界上成員最多的國際經(jīng)濟(jì)組織，世界貿(mào)易組織（World Trade Organization，WTO）成立17年來對世界經(jīng)濟(jì)的發(fā)展的作用是有目共睹的。WTO法律制度作為一類獨(dú)特的國際法律制度，自WTO成立以來就受到廣泛關(guān)注，相關(guān)的專著、論文不勝枚舉。本教材選擇WTO爭端解決機(jī)構(gòu)的專家組／上訴機(jī)構(gòu)報(bào)告，通過這些報(bào)告來了解WTO基本原則和實(shí)踐。WTO爭端解決機(jī)制專家組／上訴機(jī)構(gòu)報(bào)告是研究WTO各項(xiàng)規(guī)定最好的資料。但專家組和上訴機(jī)構(gòu)報(bào)告的篇幅都很長，一般有150。500頁，甚至長達(dá)1600多頁，而且每一個(gè)案件通常涉及多個(gè)法律問題，要全文閱讀理解，對大學(xué)本科同學(xué)有一定困難?！　【帉懻吒鶕?jù)多年的研究及教學(xué)經(jīng)驗(yàn)，對專家組和／或上訴機(jī)構(gòu)報(bào)告作了刪節(jié)，每一個(gè)報(bào)告只保留對一個(gè)法律問題的分析內(nèi)容，而以中文對案件所涉及的措施作概要介紹，以便于學(xué)生閱讀理解。

作者簡介

　　朱欖葉，畢業(yè)于復(fù)旦大學(xué)國際政治系，獲法學(xué)學(xué)士學(xué)位?，F(xiàn)任華東政法大學(xué)國際法學(xué)院教授、博士研究生導(dǎo)師，從事國際經(jīng)濟(jì)法和知識(shí)產(chǎn)權(quán)法的教學(xué)和研究。曾以訪問學(xué)者的身份分別在美國哥倫比亞大學(xué)法學(xué)院和哈佛大學(xué)法學(xué)院進(jìn)修?！　∽鳛榭妥淌谠诿绹?、比利時(shí)、荷蘭、澳大利亞、新加坡和中國香港地區(qū)等多所大學(xué)法學(xué)院講授比較知識(shí)產(chǎn)權(quán)法、中國司法制度和經(jīng)濟(jì)法、國際貿(mào)易公法等課程。　　發(fā)表《WTO國際貿(mào)易糾紛案例評(píng)析》系列著作等十余部、論文三十余篇?！　?dān)任中國國際經(jīng)濟(jì)法學(xué)會(huì)副會(huì)長、中國國際法學(xué)會(huì)常務(wù)理事、中國法學(xué)會(huì)WTO研究會(huì)副會(huì)長。經(jīng)中國政府推薦，2004年被WTO爭端解決機(jī)構(gòu)（DSB）批準(zhǔn)列入爭端解決專家名單。

　　4.The Panel proceeded to examine this issue in the light of the ordinary meaning of the term "like". It noted that the word can mean "similar" ，or "identical". The Panel then examined the practice of the Contracting Parties under the General Agreement. This practice was relevant since article 31 of the　Vienna Convention directs that " subsequent practice in the application of the treaty which establishes the agreement of the parties regarding its interpretation" is also to be considered in the interpretation of a treaty. The Panel noted that various criteria for the determination of like products under Article III had previously been applied by panels. These were summarized in the 1970 Working　Party Report on Border Tax Adjustments， which had observed：With regard to the in ten？retation of the term "like or similar products"， which occurs some sixteen times throughout the General Agreement，it was recalled that considerable discussion had taken.place but that no further improvement of the term had been achieved.　　……
