前言
三十年前,隨著改革開放序幕的拉開,中國(guó)的法學(xué)教育在高等教育中艱難地贏得一席之地,在沒有教材、沒有法規(guī)、沒有專著、沒有參考資料的艱難局面下,靠著我們前輩的無限熱情和不懈努力而蹣跚起步。正如中國(guó)人民大學(xué)著名史學(xué)家戴逸先生所說,那時(shí)的法學(xué)教育是幼稚的,基本上處于法學(xué)教育的啟蒙階段。其表現(xiàn)為老師上課念講稿,學(xué)生上課做筆記,考試背筆記。正如任何大學(xué)的長(zhǎng)成需要經(jīng)過幼苗階段一樣,老師的講授也基本停留在對(duì)法學(xué)概念的闡釋層面?! r(shí)至今日,法學(xué)學(xué)科和法學(xué)教育出現(xiàn)了一種全新的局面。目前,全國(guó)有近五百所高校設(shè)置了法學(xué)院系,全國(guó)每年招收全日制法學(xué)本科生共計(jì)十萬人左右。在法律規(guī)范層面上,社會(huì)主義市場(chǎng)經(jīng)濟(jì)法律體系已經(jīng)基本形成,全國(guó)人大及其常委會(huì)頒布的法律、國(guó)務(wù)院頒布的行政法規(guī)、國(guó)務(wù)院各部門頒布的政府規(guī)章以及最高人民法院、最高人民檢察院所作的相關(guān)司法解釋已經(jīng)深入到社會(huì)生活、經(jīng)濟(jì)生活的方方面面,無法可依的局面已經(jīng)得到徹底改觀。在法律研究層面上,幾乎有近萬部專著出現(xiàn),面對(duì)當(dāng)下之形勢(shì),法學(xué)教育何去何從,已是擺在法學(xué)教育者面前的一道現(xiàn)實(shí)課題?! r(shí)值北京市實(shí)現(xiàn)教育跨越式發(fā)展,建設(shè)100個(gè)市級(jí)本科品牌專業(yè)的偉大構(gòu)想之際,我院法學(xué)專業(yè)作為北京市市級(jí)品牌建設(shè)專業(yè),提出本科法學(xué)教育強(qiáng)化基礎(chǔ),重視應(yīng)用的教學(xué)理念,使學(xué)生做到學(xué)習(xí)平時(shí)化,目標(biāo)具體化。為了實(shí)現(xiàn)這一理念,我們除了針對(duì)教育部核定的法學(xué)專業(yè)14門核心課程推出北京市法學(xué)品牌專業(yè)核心課系列特色教材之外,同時(shí)推出北京市法學(xué)品牌專業(yè)實(shí)踐課系列特色教材,以達(dá)到重視應(yīng)用之目的?! ”咎厣滩牡奶厣谟冢旱谝唬诮滩牡木帉戵w例和內(nèi)容上,以實(shí)務(wù)中發(fā)生的真實(shí)案例為基本素材,同時(shí)通過該案例啟發(fā)學(xué)生思考的方向,并提出學(xué)生實(shí)踐的具體要求和目標(biāo)。從宏觀意義上講,法學(xué)是經(jīng)邦治國(guó)之學(xué),法學(xué)教育以培養(yǎng)經(jīng)邦治國(guó)之才為己任;從微觀意義上講,法學(xué)是維護(hù)人權(quán)之學(xué),法學(xué)教育以培養(yǎng)學(xué)生為民請(qǐng)命、為民排憂解難之品格和技能為內(nèi)容。無論是經(jīng)邦治國(guó)還是為民排憂解難都是解決形形色色的社會(huì)問題,而社會(huì)問題都集中體現(xiàn)在具體的案例中。因此,以實(shí)務(wù)中發(fā)生的真實(shí)案例為素材進(jìn)行教學(xué)是使學(xué)生了解社會(huì)、認(rèn)識(shí)社會(huì)、分析社會(huì)和解決社會(huì)問題的最佳途徑。

作者簡(jiǎn)介
張艷,女,北京工商大學(xué)法學(xué)院副教授,法學(xué)博士,經(jīng)濟(jì)學(xué)博士后,加拿大阿爾伯塔大學(xué)訪問學(xué)者。主要研究方向?yàn)閲?guó)際經(jīng)濟(jì)法、WTO法律制度和民事訴訟法。從1996年起開始用英文為本科生、研究生和留學(xué)生講授法學(xué)專業(yè)課,講授課程包括國(guó)際貿(mào)易法、國(guó)際投資法、外商投資企業(yè)法、國(guó)際貿(mào)易法律實(shí)務(wù)、國(guó)際投資法律實(shí)務(wù)和中國(guó)商法等。

Bryan, Senior Circuit Judge The defendant denied liability chiefly on the assertion that the draft did not agree with the letter's conditions, viz. , that the draft be accompanied by a "Commercial invoice in triplicate stating (inter alia) that it covers... 100% acrylic yarn"; instead, the accompanying invoices stated that the goods were "Imported Acrylic Yarn". he District Court held defendant Bank liable to Courtaulds for the amount of the draft, interest, and costs. It concluded that the draft complied with the letter of credit when each invoice is read together with the packing lists stapled to it, for the lists stated on their faces: "Cartons marked: 100% Acrylic". After considering the insistent rigidity of the law and usage of bank credits and acceptances, we must differ with the District Judge and uphold Bank's position. In utilizing the rules of construction embodied in the letter of credit——the Uniform Customs and State statute——one must constantly recall that the drawee bank is not to be embroiled in disputes between the buyer and the seller, the beneficiary of the credit. The drawee is involved only with documents, not with merchandise. Its involvement is altogether separate and apart from the transaction between the buyer and seller; its duties and liability are governed exclusively by the terms of the letter, not the terms of the parties' contract with each other. Moreover, as the predominant authorities unequivocally declare, the beneficiary must meet the terms of the credit—— and precisely——if it is to exact performance of the issuer. Failing such compliance there can be no recovery from the drawee. That is the specific failure of Courtaulds here.
